Burns Smith Law Secures Dismissal for Cherokee County Mother Arrested While Parenting Her Son

Attorney Zachary Smith demonstrated the former employer’s allegations were untrue, leading the Cherokee County Solicitor-General’s Office to dismiss the case.

CANTON, Ga. — October 14, 2026 — A Cherokee County mother arrested and charged with misdemeanor reckless conduct will not face prosecution after attorney Zachary Smith of Burns Smith Law, P.C. persuaded the State to decline the case.

The mother was arrested in 2025 after she called the police for help with her son. Smith argued that she had acted as a responsible parent, made reasonable decisions about her son’s care, and stayed within her rights. After reviewing the evidence and Smith’s presentation, the Cherokee County Solicitor-General’s Office declined to prosecute.

“Parents make judgment calls every day about how to raise their children, and the law gives them room to do that,” said Smith. “My client was doing exactly what a loving parent does. An arrest should never be the default response to ordinary parenting, and I’m grateful the State took a careful look and reached the right result.”

Smith added that the case is a reminder that an arrest is not a conviction and that anyone charged after a parenting decision should talk to a lawyer before speaking with investigators or DFCS.
