Release

CANTON, Ga. — October 7th, 2026 — Burns Smith Law, P.C. announced today that a theft by taking charge against its client has been dismissed by the Cherokee County Solicitor-General’s Office following proceedings in the State Court of Cherokee County.

The client was accused by a former employer of wrongfully taking items belonging to the business. Attorney Zachary Smith, owner and managing attorney of Burns Smith Law, went to court and established that the allegation was not true. After reviewing the facts presented by the defense, the Solicitor-General’s Office dismissed the charge.

“An accusation is not evidence, and my client should never have been charged,” said Smith. “When an employment relationship ends badly, allegations like these can surface quickly and threaten a person’s reputation and livelihood. We put the facts in front of the State, and the State did the right thing by dismissing the case. My client can now move forward with a clean slate.”

Theft by taking under O.C.G.A. § 16-8-2 can carry jail time, fines, and a lasting criminal record that affects future employment. Smith encourages anyone facing a criminal accusation from an employer to speak with a defense attorney before talking to investigators or the employer.
